CIVIL SOCIETY INSTITUTIONS: CONCEPTUAL AND THEORETICAL PROBLEMS OF REGULATORY AND LEGAL SUPPORT

Abstract

The article considers the issue of theoretical substantiation of the concept of "civil society institutions" and the problems of practical implementation of the main conceptual provisions of its substantive content in the aspect of regulatory and legal support for the processes of managing social development. Particular attention is paid to the problems of forming approaches in public administration that create a theoretical and practical basis for studying the development of civil society in general and civil society institutions in particular. It is shown that priority in theoretical and practical reflection on civil society should be given to the structural-functional approach, which makes it possible to develop an understanding of civil society in terms of purposive rationality, because the structuralfunctional approach in a single complex with the activity approach is designed to identify the general trend of achieving equilibrium in the processes of state building and social development. It is determined that the sphere of regulatory and legal regulation is directly related to the purposive rational approach and, as a rule, is result-oriented. Such a comprehensive approach should also be applied in the case of CSOs, as it makes it possible to move away from the priority of the mechanism in the public administration system to the priority of the subject of social administration, which is characterized by the presence of the same essential and integral elements described by the categories of values, expectations, priorities. It is concluded that, given the scale and consequences of these crises, it is necessary to scale up "civil society" and "civil society institutions", which will ensure their consideration in direct connection with state institutions and the formation and development of a network of relations between them in society at the vertical (subordination of civil society institutions to state authorities) and horizontal (relations between civil society entities) levels, ensuring the realization of their potential as subjects of social development management.
