DEVELOPMENT OF STATE REGULATION IN THE POSTAL SECTOR IN THE CONTEXT OF GLOBAL AND REGIONAL TRENDS

Abstract

Purpose. Development of recommendations to determine the features and factors influencing the development of the postal services market, the formation of proposals for improving the organizational and legal mechanisms of state regulation in the field of postal services by analyzing the state of the postal services market and the mechanism of its state regulation in Ukraine.Methodology. The study uses general scientific methods, in particular analysis, synthesis, systematization and a comparative approach. To achieve the set goals, a comprehensive approach is also used, which includes the study and generalization of domestic and European legislation towards research, publications, and analytical documents of the Universal Postal Union and the EU.Findings. The current state of the postal services market in Ukraine, which is successfully developing in wartime conditions and occupies high international ratings according to the Integrated Postal Development Index (2IPD of the Universal Postal Union), is analyzed. The specifics of state regulation in this area are determined, where there is minimal influence of authorities on the national regulator and on the postal services market as a whole. The main trends, models, risks, influencing factors, scenarios for the development of the postal sector in the long term according to analytical documents of the UPU and the EU are analyzed. Those must be taken into account when developing national long-term documents (strategies, plans and forecasts).Originality. The need is substantiated and specific proposals are provided for improving the legal and organizational mechanisms of state regulation. It is proposed; 1) to supplement the organizational structure of state regulation with such entities as public associations of postal operators and users; 2) introduce the institution of the postal ombudsman into the state regulation system in order to resolve out-of-court disputes between users of postal services and postal operators of the institution, and for the annual analysis of the activities of the designated operator on the effectiveness of the provision of universal postal services – an independent audit organization.Practical value. The developed proposals will allow for strengthening the compliance with domestic and European legislation, including clarifying the powers of the Ministry of Development and NCEC, implementing a European mechanism for sending cross-border parcels, increasing the responsibility of postal operators, and improving state supervision (control) tools.
