PECULIARITIES OF USING UNMANNED AERIAL VEHICLES IN VIEW OF THE PROTECTION OF THE RIGHT TO PRIVACY

Abstract

The article is devoted to highlighting the national mechanism for protecting the human and citizen's right to privacy under the legal regime of martial law related to the use of unmanned aerial vehicles and systems (hereinafter referred to as UAVs), as well as the latest technologies and software related to their use. In accordance with the set goal, the directions of UAV use are revealed, as well as the risks as a result of the impact of uncertainty on the achievement of the set goals, which relate to the infringement of the rights and freedoms of individuals during the performance of the tasks assigned to the National Police.In turn, attention is focused on a number of options for a professional approach to improving ways to solve this problem, which are based on an analysis of current legislation and a clear definition of the features of the regulatory and legal bases.The scientific novelty of the study lies in the importance and relevance of the chosen topic, given that by the order of the Ministry of Internal Affairs of Ukraine dated May 21, 2024 No. 326, UAVs were included in the list of topics of promising scientific research for 2025–2029. This indicates both a lack of awareness and the need for wide coverage of the specified topic in the scientific community, state authorities and local governments, and among the civilian population due to the versatile use of UAVs and their mass popularization. The rapid development of UAV technologies is emphasized, as new trends in their use require the legislator to pay close attention to adjusting existing legal norms for proper legal regulation of this area, preventing uncontrolled use of UAVs and preventing human rights violations due to legal conflicts. Variants of a professional approach to the legality of the use of UAVs and software based on the decisions of the European Court of Human Rights are analyzed. This will allow creating effective legislation in the field of UAV development in general and the use of technical means by the police in particular. It has been proven that the development of artificial intelligence, technical programs, and analytical support that can be used in the activities of the National Police should occur in synergy with the simultaneous extrapolation of such novelties into legislation.
