VALUE DETERMINANTS OF PROFESSIONAL ADVOCACY

Abstract

The article is devoted to the study of the implementation of the value approach to law, in particular, the substantiated value determinants of professional advocacy within the modern scientific discourse. It was found that the connection of the axiological approach in the methodology of jurisprudence with the spiritual interpretation of reality, human activity, with the ideological construction (modeling) of law and the state allows to overcome the extremes of legal positivism with its inherent formaldogmatic approach. It is determined that for a deeper understanding of law-making processes it is especially important to understand the importance of the role of values in the system of society regulation: values give rise to ideas about ideal models of social interaction. It is noted that both international and Ukrainian practices of developing legal mechanisms for regulating public relations indicate that conceptual solutions are only reliable guidelines for positive change, when they, first, come from the hopes and expectations associated with the majority. The population of the country has its own future. Secondly, when it is possible to unite the efforts of the state and society. These factors are key in the development of methodology and ideology of the legal order in society, in the development of their prospects and so on. Therefore, it is emphasized that the personality and professional activity of lawyers in the perspective of their value and motivational characteristics are rarely the subject of in-depth research. In general, this topic is covered in fragments in the scientific legal literature, which has led to the relevance of scientific intelligence. In this context, it is emphasized that the professional sphere of a lawyer reflects his most important and stable characteristics in the professional space, including the values and motives of practical activity, and, ultimately, career aspirations.
