THEORETICAL AND METHODOLOGICAL FOUNDATIONS OF THE FORMATION OF A MECHANISM FOR ENSURING LAW AND ORDER BY SUBJECTS OF THE PROVISION OF POLICE SERVICES IN CONDITIONS OF DECENTRALIZATION OF POWER

Abstract

The article is devoted to the study of modern problems of formation of the mechanism of ensuring law and order by the subjects of police services provision. The author offers her own definition of the concept of police services in the format of the public administration and management branch. It is proved that the current state of national security has actualized the study of the phenomenon of "public security" in the context of the existing terminological uncertainty of the concepts of "public order", "public safety", "public security". That is why the article presents the author's position on this terminological diversity in the context of the principles of public administration. The article substantiates a number of scientific provisions regarding law and order as a specific administrative and legal regime, and identifies the peculiarities of forming the foundations of law and order in the context of external aggression. The author describes the characteristics of the activities of police service providers in the context of forming the administrative content of decentralization of power. Based on the analysis of the current state of development of the law enforcement system and mechanism, the author's vision of the concept of "national law enforcement mechanism (NLЕM)" is formulated as a set of interrelated legal, organizational, logistical and other measures and means used by the State, State bodies, and civil society institutions to protect public relations from unlawful encroachments, to respect the rights and freedoms of citizens, to fulfill legal obligations, and to ensure the established legal order. The author improves the scientific approach to the impact of the decentralization process on the functioning of the law and order mechanism in the State. It is taken into account that the content of the existing problems of the functioning of the NLEM under the legal regime of martial law is purely subjective, since it is in the system of state power that a single (universal) perception of the content of the modern decentralization reform is formed. The article proposes new approaches to the study of the institution of law and order in the context of the military paradigm of public administration.
