LEGISLATIVE CONSOLIDATION OF THE TERM "INTERNALLY DISPLACED PERSON": DISTINCTION FROM OTHER CONCEPTS

The article is devoted to clarifying the problematic terminological aspect in the use and application of the terms "internally displaced person", "migrant", "refugee", "displaced person" and others with the aim of delimiting them, proposing changes in the legislation for unanimous interpretation and application. With the use of reference materials, the etymology of the mentioned terms was traced, their essence and peculiarities of usage were researched in historical and international understanding. Definitions from national and international legislation were given, their advantages and disadvantages were analyzed. It is stated that within one part of the article, namely Part 1 of Article 15 of the Law of Ukraine "On Ensuring the Rights and Freedoms of Internally Displaced Persons" dated October 20, 2014, two terms, "internally displaced person" and "displaced person" are used, indicating their usage as synonyms. Also, on the basis of the definitions of the concepts, their common and distinctive features were formulated. The main features distinguishing the concept of "internally displaced person" from others include: special reasons for migration (internal conflicts of an economic, political, social, personal nature; natural or manmade disasters in the country, not in the world in general); is used only in relation to those who have moved within the borders of their country, rather than go abroad; subject only to the protection of their state, as opposed to international protection for displaced persons. Another term was analyzed - forcibly displaced person, which is used as a collective term, including people displaced outside the country (migrants) and internally displaced persons, which is considered logical. This led to the conclusion of the inappropriateness of using the term "displaced person" in the mentioned law and the necessity to amend this law and other legislative acts where terms that do not correspond to the essence of the relations are unreasonably used.
