IMPROVEMENT OF THE ORGANIZATIONAL AND LEGAL MECHANISM OF INTERACTION BETWEEN PUBLIC AUTHORITY BODIES AND PUBLIC FORMATIONS IN THE CONTEXT OF ADMINISTRATIVE AND TERRITORIAL REFORM IN UKRAINE

Abstract

The article examines the organizational and legal mechanism of interaction of public authorities (state authorities, local self-government bodies, etc.) in the current context of administrative and territorial reform in Ukraine. It was determined that in the process of building a legal, democratic, social state for the formation and implementation of national, regional and local policies, the development of effective mechanisms for the participation of citizens and their associations is a priority. Terminology research was conducted on the chosen topic and it was concluded that native legislation lacks formally defined definitions (public authorities, civil society institutions, public formations), therefore suggestions for improving the relevant legislation were formulated. It was proven that the interaction between public authorities and public formations on the part of the authorities has a public law character, and on the part of public formations – a private law character. The creation and implementation of a mechanism for the interaction of public authorities and public formations in the context of administrative and territorial reform should be aimed at increasing the efficiency of management by establishing a balance regarding the place and role of the state and civil society by simplifying the process of interaction between them, minimizing bureaucratization, corruption of existing means and procedures, to be based on the principle of anthropocentrism, which implies a focus on ensuring the realization of the rights, freedoms and legitimate interests of citizens. The directions for improving the organizational and legal mechanism of interaction between public authorities and public formations in the context of administrative and territorial reform in Ukraine was proposed, which provide for the establishment of a permanent exchange of information, the creation of special commissions, councils or working groups in the development of legislative acts, planning and conducting consultations with representatives of public formations to discuss issues of the national, regional and local levels, etc.
