FORMATION OF THE MODERN CONTROL MECHANISM IN PUBLIC ADMINISTRATION

The article examines the peculiarities of the formation of a modern mechanism of public control. The components of the mechanisms of public control are analyzed based on the identification of the purpose of control in the special conditions of state formation. The purpose of public control has been clarified – the assessment of the state of compliance of the set of indicators of the activity of authorities with the rules, regulations, standards, norms and procedures established in the normative legal acts. The classification of the classical distribution of types of public control based on subjectivity and functional distribution of powers is presented. It has been proven that a rational mechanism of public control ensures the determination of the effectiveness of the functioning of the public management system, compliance with the provisions of the Constitution and laws of Ukraine, and also forms the basis of public support for such control. The essence of public support for control is determined – the perception by citizens of Ukraine of the purpose, algorithm and evaluation of control results, which aims to rationalize management relations, ensure the maximum openness of public management activities, and overcome gaps in the regulatory and legal regulation of control procedures. The peculiarity of the factor of social support of control is indicated – the formation of the institution of trust in control, which is based on the stability of control, the individual nature of control algorithms, the validity and minimization of risks. The article proves the expediency of strengthening the legitimacy of control procedures, and also points to the actualization of the actual term "public control" in the context of modern scientific discussion. It has been proven that the shift of emphasis in the interpretation of the concept of "public" to the general characteristics of administrative procedures is erroneous. It has been proven that in the context of the term "public control" we are talking about: a control algorithm established on the basis of normative legal acts, which provides for the inclusion in the control procedure of only those subjects of control activities that are directly defined in legislative acts; control procedures are defined and cannot be changed in the context of the specifics of the inspection object's activity; the procedure for publicizing inspection results provides for transparency and accessibility within the limits defined by regulatory documents. At the same time, the transparency of control should not have the nature of publicizing the specifics of the activity, if such activity is carried out within the limits of the legal field. It has been proven that such components of public control as public participation, promotion of transparent control mechanisms, transparency and openness should be based on the principles of ethics and legality.
