THE IMPACT OF COMPLIANCE CULTURE ON THE EFFECTIVENESS OF THE FUCTIONING OF PUBLIC ADMINISTRATION

This work is devoted to the study of the concept of compliance in modern private and public contexts, considering the need for processes to improve the functioning of the public administration system in Ukraine. The theoretical prerequisites for the formation of the definitive compliance apparatus were clarified, and examples of the historical prerequisites for the appearance of this phenomenon were given. It was found that compliance as a set of processes prevailed until recently in the private corporate sector of the economy. For today, it is worth talking about expanding the scope of relations for the possible application of compliance, in accordance with its possible application in the system of public administration. The spheres of application of compliance procedures and compliance of requirements were separately characterized, a conclusion was drawn about the predominant application of compliance in terms of ensuring the anti-corruption requirements of the functioning of private and public institutions within the framework of the system of relations in organizations. It has been established that the existing requirements for compliance with anti-corruption legislation are a kind of normative prerequisite for the further development of applied and theoretical requirements for the formation of compliance procedures. In the work, the author also defined other prerequisites for the possible development of compliance within the framework of public administration and found out that the prospects for further development can be determined in two possible directions: as internal compliance of subjects of public administration through the application of elements of the investigated complex phenomenon (for example, the development of ethical rules and other requirements as an organic part of the implementation of intra-organizational tasks of public administration, taking into account all compliance functions in the internal organization of the activities of public administration subjects) and as external compliance, the essence of which is to entrust the relevant bodies with the authority to develop and prepare documentation for the improvement and practical implementation of compliance procedures.
