GAINS, PROBLEMS, AND PERSPECTIVES OF UKRAINIAN COMMERCIAL PROCEDURE STUDIES IN THE EARLY 3D MILLENNIUM

Abstract

The article covers gains, problems, and perspectives of the Ukrainian сommercial procedure studies in the early 3d millennium. It addresses polythematic studies of the Ukrainian сommercial procedure law presented in dissertations. A special attention was drawn to the subjects of the dissertations dedicated to various aspects of сommercial procedure law approved by the academic boards of the higher education institutions, faculties of law (law departments), and scientific and research law centres in Ukraine over recent several years. Despite the updates to the сommercial procedure legislation of Ukraine, not all the сommercial procedure regulations and institutions (jurisdiction of economic courts, disqualifications, entities subject toсommercial procedure law, electronic evidence, legal expert's opinions, measures of procedural compulsion, writ proceedings, judicial control of the execution of judgements, resuming the lost proceedings by сommercial court, etc.) were the subject of the scientific research; many of them require a systematic analysis to be carried out by experts. It is expedient to encourage experts to study a bigger range of economic disputes having some considering and settling specifics. In addition, it is worth conducting comparative сommercial procedure studies as there are a few defended and approved topics of theses where the comparing method of scientific cognition prevails. First of all, it is interesting to explore the specifics of executing the court decisions in the European Union, the United States of America, Ukraine, and the Great Britain, as well as the specifics of settling сommercial disputes in various business areas in the foreign countries above.
