LEGAL REGIME FOR THE USE OF HUMAN ORGANS CREATED WITH THE HELP OF BIOTECHNOLOGY: BIOPRINTING IN UKRAINE AND FOREIGN COUNTRIES

Abstract

The article analyzes the legal regime of human organs and tissues created with the help of biotechnology. The issue of 3D printing of human organs was considered. The author investigates the use of bioprinting technologies in the creation of human organs and tissues. A comparative legal analysis between organ and tissue transplantation and their bioprinting was performed. Foreign experience in the issue of legal regulation of relations related to the printing of human organs and tissues was analysed. It is emphasized that transplantology, being an indicator of the evolutionary development of medicine, forms a circle of problems, the central place of which is the shortage of donor organs and tissues. The solution to the problem is 3D bioprinting, that is, the technology of creating three-dimensional models of organs and tissues based on human cells using 3D printing, which preserves the functions and viability of cells. Such a phenomenon as bioprinting, which creates many gaps in the current legislation was analysed in the research work. It was concluded that in the legislation of Ukraine, in the part related to the regulation of transplantation and the legal regime of organs and tissues, there is no legal regulation of social relations related to the creation and implantation of bioprinted human organs. The development of bioprinting technology of human organs necessitates the further improvement of legislation in the field of human health care and transplantology, as well as, of course, the adoption of a special law that would determine the legal regime of bioprinted organs at all stages of their use.
