CHILDREN`S RIGHT (STEPSON, STEPDAUGHTER) TO HEALTH CARE THROUGH THE PRISM OF IMPLEMENTATION OF THEIR DUTIES BY THE STEPFATHER, STEPMOTHER

Abstract

The article is emphasized that the right to health care, medical assistance and medical care is a constitutional and inalienable right of a person, the content of which is defined at the level of law. In particular, with regard to the child's right to health care, the Law of Ukraine "On Childhood Protection" defines that the state guarantees a child the right to health care, free qualified medical assistance in state and communal health care institutions, promotes the creation of safe conditions for life and healthy development of the child, rational nutrition, formation of healthy lifestyle skills. Authors is underlined that the duty of parents and persons who replace them, in particular – stepfathers, stepmothers, to take care of the child's health, his physical, spiritual and moral development is an integral part of upbringing and is connected with the creation of appropriate material and household conditions. Low demographic birth rates and high child mortality rates, especially in the conditions of the full-scale invasion of the Russian Federation in Ukraine, make the right to health protection of the child, along with its right to life, the most valuable rights and determine the relevance of this scientific research. The purpose of the article is determined, which consists in a thorough analysis of the legal and doctrinal foundations of the children's right to health care, proper physical, spiritual and moral development, the implementation of which fully depends on the fulfillment of this duty by parents and other persons who replace them, in particular stepfather, stepmother. It is grounded that the stepfather, stepmother are the actual educators of the stepson, stepdaughter, who have not only the right to participate in the upbringing of the stepson, stepdaughter. They are also subject to the obligations established by law, including the obligation to take care of the child's health, physical, spiritual and moral development.
