THE INSTITUTIONAL CAPACITY OF THE STATE TO ENSURE THE ESTABLISHMENT OF THE FOUNDATIONS OF THE IDEOLOGY OF SOCIAL JUSTICE IN SOCIETY, TAKING INTO ACCOUNT WAR AND POST-WAR FACTORS

Abstract

In the article, the author analyzed the institutional capacity of the state to ensure the establishment of the foundations of the ideology of social justice in society, taking into account war and post-war factors. The development of the ideology of social justice should be based on relevant institutions, which include certain norms, rules, and the socio-economic system. In Ukrainian legislation, there are multiple references to the principle of justice, but it is not specified. The decisions that will be made, and the strategy and tactics of post-war reconstruction will depend on what ideas will be the basis of the ideology of social justice. The author considered the relationship between the idea of market freedom and social justice and concluded that market freedom should be limited by morality, and society’s solidarity should consist in not using war for market purposes. The development of the ideology of social justice in society on the basis of legal regulation of the economy should be based on the achievements of scientific schools of economic and legal profile. The author analyzed which approaches are the most relevant for the socio-economic situation in Ukraine. The author studied these scientific approaches from the standpoint of the post-war reconstruction of Ukraine and analyzed how the outlined problematic issues can be solved according to one or another concept of social justice. The author concluded that the establishment of the ideology of social justice in society on the basis of legal regulation of the economy should be implemented by transforming informal ideas about social justice into concrete legal norms. Achieving such justice is impossible without the creation of adequate legal support, which must be based on effective state regulation.
